Resource The law of South Korea to prevent CTB.

Since 2020, this law has ruled my country until now.
It consists of 26 article, each article is not long relatively to other laws of SK.

I will not translate whole article. But I am going to summarise this law for the busy on their chore.
Also, some major article will be translated, and I will add a detailed explanation to each them, If I should.

In SK, it is almost impossible to die in our dignity.
Especially, all drugs and toxic materials are under this law and many harsh regulations.
Our culture used to hate CTB unconditionally, discriminate or insult all suicide and attemptors once.

For me, translating the law was very hard work. However, I wanted to introduce it to all members of SS.
I wish this thread would help people who would like to understand or know my country more.

0. First, the government of SK declared their Will to prevent CTB with their all power and resources.
In this law, they inscribed their all plans to prevent CTB, to make SK better to everyone, especially to all pro-lifers.


1. With this law, the government Can Punish anyone who distributes a specific information about CTB.
Even if they defined what is the dangerous information or not in advance, they left 'some leeway of interpretation.'

So if they consider it as a dangerous thing,
Anyone will be sentenced to a fine(20000 USD, the maximum), or to a jail for two years(the maximum) even.


2. All people in charge(ex : the police, all civil servants, all people who handle a personal information)
Must provide all related information, if there is any request to them.

If they refuse, they will be sentenced to a fine(20000 USD, the maximun), or to a jail for one year(the maximum) even.
And in some cases, some of them will be sentenced to a fine(30000 USD, the maximum), or to a jail for three years(the maximum) even.


3. The press should regulate itself when they report any case about CTB.
They should adjust themselves to all advice of the government.

국민의 소중한 생명을 보호하고 생명존중문화를 조성함을 목적으로 한다.

Article 1. The general rules and the purpose of this law.

This law defines all duties and all needs to the government to formulate all polices about preventing CTB.
This law will help the government protect all precious life of citizens in SK, will help people foster the culture of pro-life.

+ As we know, the suicide rates of SK is very high.
The government already noticed that, so they decided to prevent CTB directly.


제2조 의2(정의) 이 법에서 사용하는 용어의 뜻은 다음과 같다.

Article 2(Definition of some terms)

1. "자살위험자"란 자살의 위험에 노출되거나 노출될 가능성이 있다고 판단되는 자를 말한다.

This law handles all people who are exposed to the risk of CTB for now, or have the possibility to be exposed to the risk.

2. "자살 위해 물건" 이란 자살 수단으로 빈번하게 사용되고 있거나 가까운 장래에 자살 수단으로 빈번하게 사용될 위험이 상당한 것으로서
제10조 의2에 따른 자살예방정책위원회의 심의를 거쳐 보건복지부 장관이 고시하는 물건을 말한다.

This law handles all things to be used for CTB frequently. It also handle all things
Which have the possibility to be used for CTB in the near future.
The commission will deliberate all related material. After deliberations, the minister of Health and Welfare will declare the result to people.

3. "자살유발정보" 란 자살을 적극적으로 부추기거나 자살행위를 돕는 데 활용되는 다음 각 목의 정보를 말한다.

This law defines a dangerous information to encourage CTB or help someone do CTB.

가. 자살동반자 모집정보

First. The information about seeking the companion on CTB

나. 자살에 대한 구체적인 방법을 제시하는 정보

Second. The information which describes the detailed method for CTB

다. 자살을 실행하거나 유도하는 내용을 담은 문서, 사진 또는 동영상 등의 정보

Third. The information about execution of CTB or to induce someone to do CTB(ex : Text, Photo, Video, etc)

라. 자살위해물건의 판매 또는 활용에 관한 정보

Fourth. The information about selling any material to help do CTB or how to use them.

마. 그 밖에 위 각 목에 준하는 정보로서 명백히 자살 유발을 목적으로 하는 정보

Fifth. All other information which help someone to do CTB or induce someone to do CTB Clearly.

+ I think this is the toxic provision.


제3조(국민의 권리와 의무)

Article 3(The right and duty of all citizens)

① 국민은 자살위험에 노출되거나 스스로 노출되었다고 판단될 경우 국가 및 지방자치단체에 도움을 요청할 권리가 있다.

All citizens can ask for help of the government and all local self-government, when they are exposed to the risk of CTB.
Even someone judges him/her as a person who is exposed to the risk, he / she can ask help for them.

② 국민은 국가 및 지방자치단체가 자살예방정책을 수립ㆍ시행함에 있어 적극 협조하여야 하며,
자살을 할 위험성이 높은 자를 발견한 경우에는 구조되도록 조치를 취하여야 한다.

All citizens should cooperate with the government and all local self-government.
And if they find a person who has the high risk of CTB,
They should do anything to rescue him / her or help people rescue him / her


제19조(자살 유발 정보 예방 체계의 구축)

Article 19(To prevent citizens from distributing the information about CTB)

① 누구든지 「정보통신망 이용촉진 및 정보보호 등에 관한 법률」 제2조제1호에 따른 정보통신망을 통하여
자살유발정보를 유통하여서는 아니 된다.

Anyone Must Not distribute any information which help or induce someone to CTB via all methods for communicating.

+ ex - Internet, Digital or analogue message, Letter, all other means for communicating.

+ If they break this article, they will be sentenced to a fine(20000 USD, the maximum), or to a jail for two years(the maximum) even.


제19조 의2(자살보도 권고기준 준수 협조요청)

Article 19 - 2(To request for cooperating to observe all advice of the government)

① 보건복지부 장관은 자살사건 보도로 인한 자살의 확산을 방지하기 위하여 방송ㆍ신문ㆍ잡지 및 인터넷신문 등 언론에 대하여
제7조 제2항 제13호에 따른 자살보도에 대한 권고기준을 준수하도록 협조를 요청할 수 있다.

The minister of Health and Welfare CAN request for cooperating to the press to prevent the spread of CTB.
The press should observe all advice of the government.

+ All broadcasting, all paper newspapers, all internet newspapers, all magazines, etc


제19조 의3(긴급구조대상자 구조를 위한 정보제공요청 등)

Article 19 -3(About providing all related information to rescue the attemptor rapidly)

② 자료제공요청의 대상이 되는 자료는 긴급구조대상자의 성명, 주민등록번호(주민등록번호가 없는 경우에는 생년월일을 말한다),
주소, 전화번호, 아이디(컴퓨터시스템이나 통신망의 정당한 이용자임을 알아보기 위한 이용자 식별부호를 말한다),
전자우편주소 및 「위치정보의 보호 및 이용 등에 관한 법률」 제2조제2호에 따른 개인위치정보를 말한다.

The people in charge Must provide all information of the attemptor.
The name, the birth date and the numbers of identity card, the Address,
The Phone number, the ID on the Internet, the E-mail address, and the present location.

+ But there are some conditions. They Must confirm that the attemptor satisfied one of them at least first.

Did he / she manifest the plan or speak his / her mind to attempt to do CTB?
OR(NOT AND) Did he / she seek companion for CTB?
OR(NOT AND) Did he / she purchase something for CTB OR manifest his / her mind to purchase it?

+ 2 If they refuse to provide, they will be sentenced to a fine(20000 USD, the maximun), or to a jail for one year(the maximum) even.

And in some cases, some of them will be sentenced to a fine(30000 USD, the maximum), or to a jail for three years(the maximum) even.

제20조(자살시도자 등에 대한 지원)

Article 20(Support for all attemptors and the family of them)

① 국가 및 지방자치단체는 자살시도자 및 그 가족 또는 자살자의 유족 등에 미치는
심각한 심리적 영향의 완화와 이들의 생활안정을 위하여 자살시도자 등에게 심리상담ㆍ상담치료ㆍ법률구조 및 생계비 등을 지원할 수 있다.

The government and all local self-government CAN provide
All people who attempted to do CTB with all related counselling, treatments, legal aids and money for living.

+ Their family can be helped also.


제21조(명예 및 생활의 평온에 대한 배려)

Article 21(Consideration for honour and the peaceful life of all attemptors and the family of them)

국가 및 지방자치단체는 자살예방대책을 실시함에 있어서 자살자ㆍ자살시도자 및
이들의 가족 등의 명예 및 생활의 평온을 부당하게 침해하는 일이 없도록 하여야 한다.

The government and all local self-government Must Not violate honour and their peaceful life
Of all suicide, attemptors, and their family immoderately.

Is SN available legally in south Korea? At least charcoal / CO poisoning is a thing. (I can't think of other non crude method honestly)

SN is not illegal, but it is under this law and very strict regulations.
So it is impossible to purchase SN without any licence or authority as a mere citizen.

In addition, In SK, N is a kind of drug. Then N is illegal.
But we can purchase briquettes without any interruption still

I live in overpopulated ASEAN country do I don't think there's similiar laws like this here

So I'm learning that in Vietnam, SN is not regulated and super easy to get because it's used in a lot of the curing of meats especially Vietnamese styled sausages (Nem Nuong). Saw a shop selling a 2lb jar of it for $4 USD or 80k dong.

So this article presents itself as a nesseccery measure to ensure that the population of South Korea is made safe, for themselves and others, presenting CTB as a sort of weapon that needs to be taken away to ensure the safety of the citizens. If just skimming through it presents itself as compassionate

If just skimming alone and you see these lines, it will present itself as compassionate and understanding of the mental health crisis in South Korea and that this new law is an opportunity to mitigate, and eventually help with that issue. So these lines for the most part seems good right. A government trying to help their citizens in the times of need. But if you actually read the whole thing thoroughly. Then you'll clearly see that its not that at all. Or at the very least is nearly nice dressing to an otherwise crap salad. It's more clear that this law is for the purpose of taking freedom away from its citizens.

They are treating this like a criminal offense instead of simply people making their own choices. Cleary not considering that it might make their suicide even more of a problem in the future since they will use more desperate methods since the safer option is now illegal. The fact that they also have to pay a fine AND be in jail only makes the stigma worst, in spite of them seemingly more understanding of mental health in the first two quoted lines. This has no benefits for the citizens. But this is beneficial for both the prison industrial complex and the financial industry, since they'll be making a lot of money out of imprisoned suicidal people. So basically what this says is that if the government doesn't let them destroy peoples right to autonomy, then they will further destroy people's right to autonomy and potentially ruining their already hard lives, and making it worst further along those lines. Having depth to pay and a " felon." for being " crazy." Being in prions, even for just two years, could worsen your already fragile mental health then it already is, and combined with the dept., your probably already in a worst state then you already are.

Also having all of that broadcasted all over the media, and having that be an enforced law, is breaking citizens right to there privacy, for both them and their families. Along with destroying Some of them will probably be shamed by their families and for ruining their families " face." and ' reputation." and " showing weakness." depending on how old fashioned they are. Although they describe it as a ' request." its clearly double-speak for " we'll ask politely for you to do something we're going to force you to do any way." .This is inherently coercive since it forces the citizens to feel obligated to do the governments work out of duty, guilt, or the quiet fears of consequences if they don't do so. No freedom to determine whether they want their attempt to suicide broadcast for rating, its all up to the government, for your " safety."

This guarantee's that even people giving advise on how to CTB if they desire will be arrested and fined for the mere fact of being associated with the "crime." even indirectly. So pretty much everyone in this site would be arrested and this site would be shut down if they could. Even simply speaking about it has a high risk of arrest and fined. This is a coercive form of thought-control, where expressing your thoughts that is not valid according to the State, as sincere and honest as they are, will result in your arrest and being fined, ruining your life for even expressing yourself sincerely. Having your own neighbors reporting on this is also a form of control since you'll always have people watching your every move unless you comply to the State at your own expense.

.This is also authoritarian, taking away your anomonity for the sake of the State. All your information at the governments hands, among it easier to end your attempt at suicide and bending you to the State's wishes with this information. Plus you can never safety express your thoughts, online and in real life, without the risk of it being reported. Especially if your neighbors feel " obligated." to do so. All of your data permanently in the State's hands, especially about your utmost personals thoughts. Now at the governments hands so that they can punish you for having these thoughts(and acting on) said thoughts that's non of their business in the first place.

These laws are draconian, authoritarian, and also just plain narrow-minded. Narrow-minded because it does not address the underlining reasons of why suicide in South Korea is so bad. From its culture of collectivism to the very bad poverty in most of South Korea to its stressful and competitive nature, it only those thing things in a very narrow sense. Never going any further. Sort of similar to Neoliberal policies here in the U.S, where there policies are just enough to put a ban aid on some issues, but very clearly doesn't solve anything on a systematic and long-term level(usually by design). So this law for me seems like a Neoliberal police with an authoritarian spin to it. It merely bandaids an issues while taking away citizens rights for " there own good."

So this law very clearly does more harm then good. In both the short-term, and the long-term. Whether the governments aware of it or not( or doesn't care.). This law seems more concerned with preventing this problem from being part of the conversation and taking away the citizens autonomy for the sake of the State then in solving the issue long-term.

If just skimming alone and you see these lines, it will present itself as compassionate and understanding of the mental health crisis in South Korea and that this new law is an opportunity to mitigate, and eventually help with that issue. So these lines for the most part seems good right. A government trying to help their citizens in the times of need. But if you actually read the whole thing thoroughly. Then you'll clearly see that its not that at all. Or at the very least is nearly nice dressing to an otherwise crap salad. It's more clear that this law is for the purpose of taking freedom away from its citizens.


They are treating this like a criminal offense instead of simply people making their own choices. Cleary not considering that it might make their suicide even more of a problem in the future since they will use more desperate methods since the safer option is now illegal. The fact that they also have to pay a fine AND be in jail only makes the stigma worst, in spite of them seemingly more understanding of mental health in the first two quoted lines. This has no benefits for the citizens. But this is beneficial for both the prison industrial complex and the financial industry, since they'll be making a lot of money out of imprisoned suicidal people. So basically what this says is that if the government doesn't let them destroy peoples right to autonomy, then they will further destroy people's right to autonomy and potentially ruining their already hard lives, and making it worst further along those lines. Having depth to pay and a " felon." for being " crazy." Being in prions, even for just two years, could worsen your already fragile mental health then it already is, and combined with the dept., your probably already in a worst state then you already are.

Also having all of that broadcasted all over the media, and having that be an enforced law, is breaking citizens right to there privacy, for both them and their families. Along with destroying Some of them will probably be shamed by their families and for ruining their families " face." and ' reputation." and " showing weakness." depending on how old fashioned they are. Although they describe it as a ' request." its clearly double-speak for " we'll ask politely for you to do something we're going to force you to do any way." .This is inherently coercive since it forces the citizens to feel obligated to do the governments work out of duty, guilt, or the quiet fears of consequences if they don't do so. No freedom to determine whether they want their attempt to suicide broadcast for rating, its all up to the government, for your " safety."

This guarantee's that even people giving advise on how to CTB if they desire will be arrested and fined for the mere fact of being associated with the "crime." even indirectly. So pretty much everyone in this site would be arrested and this site would be shut down if they could. Even simply speaking about it has a high risk of arrest and fined. This is a coercive form of thought-control, where expressing your thoughts that is not valid according to the State, as sincere and honest as they are, will result in your arrest and being fined, ruining your life for even expressing yourself sincerely. Having your own neighbors reporting on this is also a form of control since you'll always have people watching your every move unless you comply to the State at your own expense.


.This is also authoritarian, taking away your anomonity for the sake of the State. All your information at the governments hands, among it easier to end your attempt at suicide and bending you to the State's wishes with this information. Plus you can never safety express your thoughts, online and in real life, without the risk of it being reported. Especially if your neighbors feel " obligated." to do so. All of your data permanently in the State's hands, especially about your utmost personals thoughts. Now at the governments hands so that they can punish you for having these thoughts(and acting on) said thoughts that's non of their business in the first place.

These laws are draconian, authoritarian, and also just plain narrow-minded. Narrow-minded because it does not address the underlining reasons of why suicide in South Korea is so bad. From its culture of collectivism to the very bad poverty in most of South Korea to its stressful and competitive nature, it only those thing things in a very narrow sense. Never going any further. Sort of similar to Neoliberal policies here in the U.S, where there policies are just enough to put a ban aid on some issues, but very clearly doesn't solve anything on a systematic and long-term level(usually by design). So this law for me seems like a Neoliberal police with an authoritarian spin to it. It merely bandaids an issues while taking away citizens rights for " there own good."

So this law very clearly does more harm then good. In both the short-term, and the long-term. Whether the governments aware of it or not( or doesn't care.). This law seems more concerned with preventing this problem from being part of the conversation and taking away the citizens autonomy for the sake of the State then in solving the issue long-term.

I spent 5 years in South Korea and was a bit shocked by people's reluctance to talk about mental health and suicide. The glaring, shallow commercialism was also jarring to see, though it's not *that* different from being in the US in my opinion...definitely do not see how Korea can try to legislate this.

It seems to be a real low-effort way to try to curb the suicide rate (symptom), instead, as others have said, attacking the real causes. Not exactly hopeful that it'll change in South Korea or in the US. I wish society were more friendly and supportive to people on the edge.

This laws is similar to France, since a book called "Suicide: Mode d'emploi" a French similar book to Peaceful Handbook. Since 80's 90's, France considers this book illegal and create similar laws as SK. "Deomcracy", but of course. CTB is similar to Prison Break in these countries.
